There is no procedure for grant of licenses over designs in Tanzania. Similary, there is no procedure for recordal of assignments. For United Kingdom registered designs, grant of licenses and recordal of assigments can be requested at the UK Patent Office. For designs registered with ARIPO, requests for grant of licenses and recordal of assignments may be requested at ARIPO Office.
Licenses (non-exclusive and exclusive) may be granted over designs registered with ARIPO Office. The owner of the design must, for the entire duration of the license agreement, guarantee that no right will be granted to a third party which might impede or limit the exploitation by the licensee. If such right is nevertheless granted, the licensee may terminate the license agreement with immediate effect. A license agreement will be exclusive only if explicitly stipulated. The licensee is generally not entitled to grant sub-licenses unless the owner of the design has given express authorisation. If the registration of a licensed design is cancelled with retroactive effect, the licensee may claim refund only of that part of the royalties paid which is not covered by the profits derived from the exploitation of the design.
Licenses and assignment at ARIPO Office must be recorded in order to be effective against third parties. Requirements for recording are: 1. Deed of assignment signed by assignor and assignee, not legalized; and 2. Power of attorney signed by assignee, not legalized.
